Extended Producer Responsibility (EPR) is an environmental policy approach where producers are responsible for the entire lifecycle of their products, including post-consumer waste management. It shifts the responsibility of waste management from municipalities to the producers, requiring them to collect, recycle, and safely dispose of their products after consumer use.

An EPR Certificate is an official document issued by authorized regulatory bodies confirming that a producer or brand owner has fulfilled their Extended Producer Responsibility obligations. It serves as evidence that the company has collected and processed the required quantity of waste generated from their products in accordance with environmental regulations.

EPR registration is mandatory for producers, importers, and brand owners who introduce packaging (plastic, paper, glass, metal), e-waste, batteries, or other regulated materials into the market. This includes manufacturers, online marketplaces, importers, and companies using packaging for their products, regardless of their size if they exceed the minimum threshold quantities specified in the regulations.

EPR in India currently covers plastic packaging waste (including multi-layered and single-use plastics), e-waste (electronic and electrical equipment), batteries (lead-acid and lithium-ion), and packaging materials (paper, glass, metal). The scope is continuously expanding with new waste streams being added under various environmental protection regulations.

The primary regulations include Plastic Waste Management Rules, 2016 (amended in 2021 and 2022), E-Waste Management Rules, 2016 (amended in 2018), Battery Waste Management Rules, 2022, and the EPR Guidelines for packaging waste issued by the Ministry of Environment, Forest and Climate Change (MoEFCC). These are implemented through the Central Pollution Control Board (CPCB) and State Pollution Control Boards (SPCBs).

EPR Certificates are typically valid for one financial year (April to March). Companies must renew their EPR registration annually and fulfill their waste collection targets for each year separately. The certificate confirms compliance for the specific period mentioned on it and cannot be carried forward to subsequent years.

EPR targets are the mandatory quantities of waste that producers must collect and process, calculated as a percentage of the total material they introduce into the market. For plastic packaging, current targets range from 70% to 100% depending on the category and year. These targets are progressive, increasing annually to eventually achieve complete waste recovery.

Plastic packaging is categorized into four types under EPR: Category 1 (Rigid plastic), Category 2 (Flexible plastic packaging of single layer or multilayer with plastic as the predominant material), Category 3 (Multi-layered plastic packaging with at least one layer of plastic and primarily paper), and Category 4 (Plastic sheets or pouches used for packaging).

A Producer is an entity engaged in manufacturing or importing products with packaging materials. A Brand Owner is a company that sells products under its own brand name, regardless of whether they manufacture the products themselves. Both have EPR obligations, but the responsibility lies with the entity that first introduces the packaged product into the market.

A Producer Responsibility Organization (PRO) is a professional entity authorized by CPCB that helps producers fulfill their EPR obligations. PROs manage the collection, segregation, recycling, and documentation of waste on behalf of multiple producers. They create economies of scale in waste management and simplify compliance for individual companies through their established networks of waste collectors and recyclers.

An EPR Action Plan is a detailed document submitted by producers to regulatory authorities outlining how they plan to fulfill their EPR obligations. It includes information on waste quantities, collection mechanisms, recycling partners, awareness programs, and timelines. The plan must be approved by the CPCB/SPCB before implementation and serves as a roadmap for the company's waste management activities.

Companies must maintain detailed records of the quantity and type of packaging/products introduced into the market, waste collected category-wise, recycling certificates from authorized recyclers, agreements with PROs or waste management agencies, and proof of environmental awareness activities. These records must be preserved for at least five years and be available for inspection by regulatory authorities.

The EPR Portal is an online platform developed by the Central Pollution Control Board (CPCB) for managing EPR registrations and compliance. It allows producers to register, submit action plans, report waste collection data, and obtain EPR certificates. The portal also maintains a database of authorized recyclers, PROs, and waste processors to facilitate the EPR implementation process.

Non-compliance with EPR regulations can result in penalties under the Environment Protection Act, including fines up to Rs. 1 lakh and imprisonment up to 5 years. Additional consequences include environmental compensation charges based on the polluter pays principle, closure notices for business operations, and reputational damage. Repeated violations may lead to stricter penalties and permanent cancellation of business permits.

EPR is a policy approach that makes producers responsible for the end-of-life management of their products. The Plastic Waste Management Rules are specific regulations that implement EPR for plastic packaging in India. PWM Rules provide the legal framework, while EPR is the principle being enforced through these rules, covering collection targets, registration requirements, and compliance mechanisms.

While producers can outsource the physical implementation of EPR to PROs or waste management agencies, the legal responsibility remains with the producer/brand owner. Companies can enter into agreements with PROs to manage waste collection and recycling on their behalf, but they remain accountable to authorities for meeting targets and ensuring proper documentation and reporting.

Recyclers are authorized entities that process collected waste into reusable materials. They must be registered with CPCB/SPCB and follow prescribed environmental standards. Recyclers issue certificates confirming the quantity of waste processed, which producers use as evidence of EPR compliance. The recycling infrastructure is critical to the success of the EPR framework.

The EPR Credit System allows producers who collect more waste than their targets to sell excess credits to those struggling to meet their obligations. These tradable certificates represent a specific quantity of waste collected and recycled beyond the mandatory requirements. The system aims to create market-based incentives for efficient waste management while ensuring overall targets are met.
